On July 28, 2023, Regulation 1545/2023 amending Cosmetics Regulation 1223/2009 was issued and will be published on August 17 for implementation.
This new regulatory update undoubtedly presents additional challenges for our companies. Regulation 1545/2023 introduces stricter standards for the safety of ingredients and formulations for cosmetic products. It amends Annex 3 (Regulated Substances) of Cosmetics Regulation 1223/2009 by increasing the number of allergenic substances from 24 to 82. These 58 additional natural or synthetic substances must appear on our labels whenever they are included in the composition of our products in concentrations greater than 0.01% for rinse-off products and 0.001% for leave-on products, as previously.
These substances include, among others, the following natural substances:
- Essential oils and extracts of:
- Atlas cedar
- Pine
- Patchouli
- Rose
- Verveine absolutes
- The essential oil of:
- Lemon
- Sweet orange
- Eucalyptus
- Mint, Spearmint, and Peppermint
- Narcissus
- Sandalwood
They must be listed as such, but any other allergenic substances they contain must also be listed where applicable. For example, for Sweet Orange essential oil, not only must the allergens Limonene and Linalool (where applicable) be listed, but also «... Citrus Aurantium Dulcis Peel Oil, Limonene, Linalool» (where applicable).
This constraint could require significant adjustments to our labeling processes and updates to our DIPs.
Similarly, the 51st amendment to the IFRA imposes new restrictions on a dozen fragrances. These include geraniol and eugenol, which are very commonly used in our products and for which the maximum permitted levels have been reduced.
